Who is a New York State resident?

You are considered a resident if you maintained a permanent place of residence in NYS and spent more than 184 days there during the tax year.

What are the filing requirements for New York State residents?
  • You are required to file a federal income tax return.
  • Your federal adjusted gross income plus New York additions was more than $4,000 ($3,100 if you are single and can be claimed as someone’s dependent).
  • You would like to claim a refund of any New York State, New York City, or Yonkers income taxes withheld from your paycheck.
  • You want to claim any of the refundable or carryover credits that are available.
